Information regarding the processing of personal data
by Zakłady Elektrotechniki Motoryzniczej ZEM Sp. z o.o.

In accordance with art. 13 section 1 and item 2 of the General Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR), we inform you that:

1. The administrator of your personal data is:
Zakłady Elektrotechniki Motoryzniczej ZEM Sp. z o.o., with its registered office in Duszniki-Zdrój, at ul. Sudecka 14, KRS 0000077725, NIP 8831701904.

2. Personal data has been obtained from recruitment documents or a contact form and will be processed for the purposes of:
a) employment and employment related records;
b) financial and accounting (processing is necessary to comply with the law, for a period regulated by tax law);
c) defense against claims and pursuing claims of the legitimate interest of ZEM Sp. z o.o., until the expiry of the claims period in accordance with the Civil Code;
d) enabling the provision of electronic services, including the handling of notifications;
e) operating system user account management;
f) performance of contracts concluded under a sales contract with other customers;
g) debt collection, conducting court, arbitration and mediation proceedings;
h) conducting statistical analyzes;
i) archiving, including documenting accountability (i.e. demonstrating compliance with obligations arising from legal provisions).

3. Category of personal data:
Sensitive data in the form of names, surnames (including family names), dates and places of birth, social security numbers, addresses of residence, registration and employment, job positions, qualifications, the amount of remuneration, telephone numbers and containing the type, series and ID card number.

4. Your personal data will not be transferred to third countries and international organizations.

5. Your personal data will be stored for the period of:
a) necessary to achieve the purposes of processing;
b) the validity of the contract, and after its termination for the purpose of pursuing claims in connection with the performance of the contract and performance of obligations arising from legal provisions (here: tax, accounting, social security system);
c) necessary for carrying out processing operations or until objecting to processing;
d) associated with the obligation of accountability (here: proof of compliance with the provisions on the processing of personal data; data will be stored for the period in which we are required to keep them, including documents containing data to document compliance with legal requirements and to enable control of their compliance by public authorities) .
We do not process personal data for purposes other than those specified above.

6. The recipients of your personal data are:
a) state institutions (including ZUS, Tax Office);
b) entities acting as intermediaries in the performance of contractual obligations by the Administrator (including IT service providers who have been entrusted with services related to the processing of personal data under the contract and in accordance with the recommendations of ZEM Sp.z o.o. a law firm).

7. You have the right to:
a) access to content and transfer of your data;
b) rectification, deletion and limitation of data processing;
c) object to the processing;
d) withdrawal of consent to data processing at any time (for this purpose you can contact the Data Protection Officer, the above-mentioned law does not affect the processing that took place on the basis of consent before its withdrawal);
e) request from the Administrator access to personal data;
f) lodging a complaint in connection with the processing of personal data by ZEM Sp. z o.o., to the supervisory body of the President of the Office for Personal Data Protection, when it is justified that your personal data is processed by the Administrator in breach of the General Regulation on the protection of personal data of 27 April 2016.

9. Your personal data may be disclosed:
a) only to entities with whom contracts for entrusting the processing of personal data have been concluded;
b) persons and entities at their legitimate request, in accordance with applicable provisions on the protection of personal data;
c) entities supporting the provision of electronic services (including payment and insurance services, supporting users);
d) public bodies fighting fraud and abuse.

10. Your personal data will not be processed in an automated manner and will not be profiled.
Providing personal data is mandatory under the law, and failure to provide data to the extent required by the Administrator will prevent the preparation of necessary documentation and may result in the inability to carry out the recruitment and employment process.
The Administrator makes every effort to ensure all physical, technical and organizational measures to protect personal data against accidental or unintentional destruction, accidental loss, alteration, unauthorized disclosure, use or access, in accordance with all applicable law.

In accordance with art. 13 section 1 point e GDPR, the information clause does not require consent, it is a document meeting the information obligation that we implement as a Data Administrator.
